Chapter 7 Bankruptcy

The U.S. Bankruptcy Code bestows the right upon the American people to eliminate their debt through a federal procedure known as bankruptcy. Bankruptcy is defined as “a person judged by a court to be insolvent, whose property is taken and disposed of for
the benefit of creditors.” This definition of bankruptcy best describes the bankruptcy procedure under Chapter 7 of the Bankruptcy Code. A chapter 7 attorney is retained in this procedure to assist in the filing.

Chapter 7 bankruptcy is essentially a liquidation event. A liquidation event is when an estate is “liquidated,” sold to the highest bidder, whereby the proceeds are disbursed to a third party. The third party in this context would be a debtor’s creditors.

Once a debtor files for Chapter 7 bankruptcy protection, the Bankruptcy Court automatically issues an automatic stay. A chapter 7 attorney is should be retained at this stage to file the petition. An automatic stay is an order from the Bankruptcy Court that essentially halts virtually all collections activities by that debtor’s
creditors. The Bankruptcy Court then assigns a third party trustee. The trustee’s position in this context is to manage the debtor’s assets and debts, or in other words, the estate, on behalf of the Court.

The debtor comes into contact with the trustee only once during this proceeding (that’s if everything goes well and according to plan). What do you mean by according to plan? A bankruptcy going well and according to plan essentially means that the debtor has been completely truthful and open in their bankruptcy petition. The petition is the document or series of documents the debtor submits to the court, in essence to “claim” bankruptcy. This occurs as a voluntary bankruptcy
proceeding; most consumer bankruptcies are voluntary. On the other hand, businesses are sometimes forced to file for bankruptcy, under Chapter 11 of the U.S. Bankruptcy Code.

The debtor would come into contact with the trustee only once (subject to the condition described above). The hearing that the trustee and the debtor are present in is referred to the 341 meeting, or the creditor’s meeting. This is an informal hearing held at the local bankruptcy court. This hearing is set-up and the date assigned
almost immediately upon the filing of the debtor’s bankruptcy petition. After the Bankruptcy Court has assigned a date, both parties, the debtor and the debtor’s creditors, are informed.

The 341 meeting is not attended by a Bankruptcy Judge, but is rather run by the trustee. This meeting lasts for about twenty minutes and is attended by the debtor’s bankruptcy attorney, if the debtor has retained one. At the 341 meeting, the trustee asks the debtor a series of questions to determine whether the debtor has been completely truthful and honest with the statements made in the bankruptcy petition.

If all goes well, then the trustee signs off on the case and Bankruptcy Court issues a discharge. This signifies the end of the bankruptcy proceedings.
